Booking Terms
1. Scope of Application
These Terms & Conditions apply to all rental agreements and transactions between Shutterclub and the customer, unless otherwise agreed in writing.
If the customer is a business, these terms also apply to future rental agreements, even if not explicitly restated. Any differing customer terms require our written confirmation to be valid.
2. Services Provided
The services covered by these Terms include the rental of photo and video equipment, unless otherwise stated in a specific offer. The exact equipment, rental duration, and fees are defined in the rental agreement process, which is binding once confirmed and paid.
3. Rental Agreement
A binding contract is formed only after:
- The customer submits a booking request or order.
- We send a rental offer with the deposit.
- The customer confirms the offer by transferring the deposit.
Rental extensions or additional equipment requests are subject to availability and require separate confirmation and payment.
4. Cancellations
If the customer cancels after payment, the following cancellation fees apply:
- More than 14 days before rental start: Free cancellation.
- 14 to 3 days before rental start: 25% of the rental price.
- Less than 3 days before rental start: 50% of the rental price.
- On the first rental day or later: 100% of the rental price.
If the booking can be rescheduled, we’ll try to accommodate this, subject to availability. If not possible, the above cancellation fees apply.
5. Rental Costs
Rental costs are charged per calendar day, based on the pricing provided at the time of booking. Additional days are charged accordingly. All prices include applicable taxes unless otherwise stated.
6. Customer Responsibilities & Liability
Customers are fully responsible for the rented equipment from pickup until return.
They agree to:
- Use the gear only for its intended purpose.
- Avoid exposing it to damage, theft, or loss.
- Return it in the same condition it was received.
- Securely package and send a tracking number on the last day of rental.
In case of damage, loss, or theft, the customer may be liable for repair or replacement costs. We recommend customers ensure the gear is covered by personal liability or production insurance. The renter also bears the risk and cost of return shipping.
We are not liable for:
- Data loss, corrupted files, or footage issues.
- Incorrect camera settings or exposure errors.
- Missed shots or malfunction caused by improper use.
Customers are responsible for testing the gear and backing up their data during the rental period.
7. Limitations of Liability
We are only liable for damages caused intentionally or by gross negligence. For minor negligence, liability only applies if essential contractual obligations were violated, and is limited to foreseeable, typical damage—up to the rental fee.
We are not liable for any indirect damages, lost profits, or damages resulting from misuse. Mandatory liability under applicable laws (e.g. product liability) remains unaffected.
8. Pick-up, Return & Late Fees
- Equipment must be picked up and returned at the agreed times and location.
- Late returns may incur additional daily fees.
- A grace period may be granted at our discretion.
8. Non-Return and Theft
Failure to return rented equipment by the agreed return date without prior written agreement will be considered a breach of contract. If the renter does not respond within 48 hours of the agreed return time, we reserve the right to initiate formal procedures.
After this period, the case may be treated as theft, and appropriate legal steps will be taken, including the filing of a police report. The renter agrees to be fully liable for the replacement value of the equipment, plus any associated loss of income, legal fees, and administrative costs.
We also reserve the right to charge continued daily rental fees until the item is returned or reimbursed. The renter acknowledges and agrees to this by accepting these terms at the time of booking.
9. Use Restrictions
Rental items must not be:
- Sub-leased to third parties.
- Taken to high-risk locations without prior agreement.
- Shipped internationally without explicit approval.
10. Governing Law & Jurisdiction
These terms are governed by the laws of Luxembourg, excluding international sales law (CISG). Jurisdiction lies with the courts of Luxembourg.
11. Severability Clause
If any provision in these Terms is found to be invalid or unenforceable, the rest of the Terms remain unaffected. The invalid provision will be replaced with one that comes closest to the original intent.
